Adrenaline Rush Trail Pte Inc is a tour company operating in several ASEAN Countries (collectively referred to as “Adrenaline Rush Trail Pte Inc”, “we”, “our” or “us”), This privacy policy contains information on how Adrenaline Rush Trail Pte Inc collects, uses, and shares information collected from you as well as how such information is protected from unauthorized access. Adrenaline Rush Trail Pte Inc uses cookies to recognize repeat users, facilitate the user’s ongoing access to and use of the Site, track Site usage behavior, and compile aggregate data that will allow content improvements and targeted advertising. Adrenaline Rush Trail Pte Inc does not sell any of your Personal Information to third parties for any reason. As noted above, Adrenaline Rush Trail Pte Inc may share some of your Personal Information with certain third parties in order to properly run its business, including the operation of its motorcycle rental/tour services. For example, your name and credit card information will be shared with our credit card processing vendor in order to process payments. Personal Information is not shared with third parties for use in connection with their own purposes, but only ’ for Adrenaline Rush Trail Pte Inc’s own business purposes and to better serve our Site users. Adrenaline Rush Trail Pte Inc may also disclose your Personal Information if required to do so by law, or in a good-faith belief that such action is necessary: (a) to comply with applicable law or with legal process served on Adrenaline Rush Trail Pte Inc or the Site; (b) to protect and defend the rights or property of Adrenaline Rush Trail Pte Inc or the Site; or (c) if Adrenaline Rush Trail Pte Inc’s ownership status changes, such as it being acquired by another party.
Online reservations and bookings for motorcycle rentals and tours are handled by a third-party vendor, namely, Koh Life or other booking systems. In connection with making reservations and bookings, you will leave the Site and go to a site maintained by Koh Life or other booking systems. Further, when making reservations or bookings through the site maintained by Koh Life or other booking systems, you will be bound by Koh Life or other booking systems’ privacy policy regarding the collection of information. Please note that any information you provide to Koh Life or other booking systems as part of reserving or booking with Adrenaline Rush Trail Pte Inc will be shared with Adrenaline Rush Trail Pte Inc for reasons consistent with how we use information collected directly through the Site.
Our legal basis for collecting and using the Personal Information described above will depend on the Personal Information concerned and the specific context in which we collect it. However, we will normally collect Personal Information from you only where we have your consent to do so, where we need the Personal Information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. While Adrenaline Rush Trail Pte Inc takes the security of your information seriously, there is no system that is one hundred percent secure from outside threats. RIDER REQUIREMENTS

(a) The RIDER must prove to be at least 25 years of age to rent and ride the motorcycle.
(a) RIDER phải chứng minh được ít nhất 25 tuổi để thuê và lái xe mô tô.
(b) In order to rent and ride a motorcycle with an engine size of 175cc or greater, the RIDER must have and be in possession of a valid Driver’s License with Motorcycle endorsement valid for riding all sizes of motorcycle.
(b) Để thuê và lái xe mô tô có kích thước động cơ từ 175cc trở lên, RIDER phải có và sở hữu Giấy phép Lái xe mô tô (A2) hợp lệ có xác nhận Xe mô tô có giá trị để lái mọi kích thước mô tô.
(c) The RIDER, if not in possession of a valid Vietnamese license, is required to have in his/her possession a valid International Driver’s Permit which is valid for the entire length of the rental period.
(c) RIDER, nếu không có Giấy phép lái xe mô tô (A2) hợp lệ của Việt Nam, bắt buộc phải có Giấy phép Lái xe Quốc tế hợp lệ có giá trị trong toàn bộ thời gian thuê.
(d) The RIDER must, when picking up the motorcycle, must allow A.R.T VIET NAM TOURISM COMPANY LIMITED to take pictures of: Passport, Driver’s License and International Driver’s Permit. All information will be kept private unless otherwise justified.
(d) RIDER khi nhận xe phải cho CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM chụp ảnh: Hộ chiếu, Giấy phép Lái xe và Giấy phép Lái xe Quốc tế. Tất cả thông tin sẽ được giữ bí mật trừ khi có lý do khác.
(e) The RIDER agrees to authorize A.R.T VIET NAM TOURISM COMPANY LIMITED to charge the RIDER’s credit card for the following:
Late return, extra rental days
Damage, theft, loss or non-return of the motorcycle and/or any equipment
Expenses incurred by A.R.T VIET NAM TOURISM CO. in order to bring the motorcycle and/or any equipment back to its original state and predetermined drop off location
Any other expenses incurred related to or resulting from any of the above
(e) RIDER đồng ý ủy quyền cho CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM tính phí vào thẻ tín dụng của RIDER cho những việc sau:
Trả lại muộn, thêm ngày thuê
Thiệt hại, trộm cắp, mất mát hoặc không trả lại xe mô tô và / hoặc bất kỳ thiết bị nào
Công ty TNHH DU LỊCH A.R.T VIỆT NAM chịu chi phí để đưa xe mô tô và / hoặc bất kỳ thiết bị nào về trạng thái ban đầu và địa điểm trả khách đã định trước
Bất kỳ chi phí nào khác phát sinh liên quan hoặc phát sinh từ bất kỳ điều nào ở trên
BOOKING TERMS

(a) To confirm a booking, a 50% deposit must be paid in full.
(a) Để xác nhận đặt chỗ, bạn phải thanh toán đầy đủ 50% tiền đặt cọc.
(b) Payment in full must be made must be made prior to the rental start date.
(b) Thanh toán đầy đủ phải được thực hiện trước ngày bắt đầu thuê.
(c) A deposit of $2000 or $3000 will be charged to the Riders’ credit card when the motorcycle is picked up. The sum will be held as a damage deposit and will be refunded to the Rider when the motorcycle is returned.
(c) Khoản đặt cọc $ 2000 hoặc $ 3000 sẽ được tính vào thẻ tín dụng của Người lái khi xe mô tô được nhận. Số tiền này sẽ được giữ như một khoản đặt cọc cho thiệt hại và sẽ được hoàn lại cho Người lái khi xe mô tô được trả lại.
(d) Payments are made by using the payment link provided in the quote or on the adrenalinrushtrail.com website, unless otherwise agreed to by A.R.T VIET NAM TOURISM CO. LTD.
(d) Việc thanh toán được thực hiện bằng cách sử dụng liên kết thanh toán được cung cấp trong báo giá hoặc trên trang web adrenalinrushtrail.com, trừ khi được A.R.T VIET NAM TOURISM CO. LTD đồng ý khác.
(e) For payments made using the payment portal on the adrenalinrushtrail.com website, VISA card, MasterCard, Discover, JCB, Diners, AMEX and PayPal are accepted. The customer is responsible for any online booking fees.
(e) Đối với các khoản thanh toán được thực hiện bằng cổng thanh toán trên trang web adrenalinrushtrail.com, thẻ VISA, MasterCard, Discover, JCB, Diners, AMEX và PayPal đều được chấp nhận. Khách hàng chịu trách nhiệm về mọi khoản phí đặt chỗ trực tuyến.
(f) Rental Rates vary depending on the duration of rental, as stipulated in the online booking issued and approved by A.R.T VIET NAM TOURISM CO. LTD
(f) Giá thuê thay đổi tùy thuộc vào thời gian thuê, theo quy định trong đặt chỗ trực tuyến do A.R.T VIET NAM TOURISM CO. LTD phát hành và chấp thuận
(g) A rental day is defined as a 24 hour period. Motorcycles can only be rented in blocks of 24 hours.
(g) Một ngày thuê được định nghĩa là khoảng thời gian 24 giờ. Chỉ có thể thuê xe máy theo khối trong 24h.
(h) The duration of the rental period is calculated using the agreed start date and the agreed completion date.
(h) Thời gian thuê được tính theo ngày bắt đầu đã thỏa thuận và ngày hoàn thành đã thỏa thuận.
(i) The rental booking may be cancelled at any time, however all cancellations must be received in writing (e-mail), and cancellation charges may apply.

Cancellations made on day of departure or after departure : no refund

(k) A.R.T VIET NAM TOURISM CO. LTD motorcycle rentals do not include any additional equipment, unless otherwise stated on the adrenalinrushtrail.com website. Equipment, such as helmets, jackets and wet-weather gear are available for hire, subject to availability and should be booked and paid for along with the motorcycle.
(k) Dịch vụ cho thuê xe mô tô của A.R.T VIET NAM TOURISM CO. LTD không bao gồm bất kỳ thiết bị bổ sung nào, trừ khi có quy định khác trên trang web adrenalinrushtrail.com. Các thiết bị, chẳng hạn như mũ bảo hiểm, áo khoác và dụng cụ chống ẩm ướt có sẵn cho thuê, tùy thuộc vào tình trạng sẵn có và phải được đặt trước và thanh toán cùng với xe mô tô.
(l) All prices on the A.R.T VIET NAM TOURISM CO. LTD website includes 10% Vietnamese consumption tax.

(m) Any and all expenses incurred during the RIDER’s trip that are not explicitly mentioned as the responsibility of A.R.T VIET NAM TOURISM CO. LTD are the responsibility of the RIDER and are not the responsibility of A.R.T VIET NAM TOURISM CO. LTD.
(m) Bất kỳ và tất cả các chi phí phát sinh trong chuyến đi của Người lái xe mà không được đề cập rõ ràng thuộc trách nhiệm của A.R.T VIET NAM TOURISM CO. LTD thì sẽ là trách nhiệm của Người lái xe và không phải là trách nhiệm của A.R.T VIET NAM TOURISM CO. LTD.
n) Allow 48 hours notice for changes to the Rental Agreement start and completion date. We will try our best to accommodate changes but are subject to availability.

o) The Rider will be charged USD $50 for key replacements.

(a) All motorcycle prices include motorcycle insurance. Insurance coverage is included and non-negotiable.

MOTORCYCLE PICK-UP
NHẬN XE MÁY
(a) Prior to taking possession of the motorcycle, the RIDER must sign a Liability Release and provide the necessary documentation and take the required customer orientation, which is carried out at the time A.R.T VIET NAM TOURISM CO. LTD hands over the motorcycle. This takes approximately 1 hour, therefore it is recommended that the RIDER arrive 1 hour prior to his/her time of departure. The orientation session will include an explanation of basic motorcycle maintenance, rider safety information, Vietnam’s road rules, insurance coverage, and procedures to be carried out in the event of an accident or breakdown.
(a) Trước khi nhận xe mô tô, Người lái xe phải ký Giấy xác nhận trách nhiệm và cung cấp các tài liệu cần thiết và định hướng khách hàng theo yêu cầu, được thực hiện tại thời điểm A.R.T VIET NAM TOURISM CO. LTD bàn giao xe mô tô. Quá trình này mất khoảng 1 giờ, do đó, Người lái xe nên đến trước 1 giờ so với thời gian khởi hành. Buổi hướng dẫn sẽ bao gồm giải thích về bảo dưỡng xe máy cơ bản, thông tin an toàn cho người lái, các quy tắc đường bộ của Việt Nam, phạm vi bảo hiểm và các thủ tục sẽ được thực hiện trong trường hợp xảy ra tai nạn hoặc hỏng hóc.
(b) If A.R.T VIET NAM TOURISM CO. LTD is unable to provide the reserved motorcycle due to unforeseen circumstances, a similar or better motorcycle will be provided at the same daily rate. If the RIDER is unsatisfied with the alternative motorcycle, the RIDER reserves the right to cancel the ‘Rental Agreement’ and then receive a 100% refund of the amount for the motorcycle and equipment, provided however, the RIDER does not cancel the booking without rational reason. Refunds will be processed in a timely manner.
(b) Nếu CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM không thể cung cấp xe mô tô đã đặt trước do các trường hợp bất khả kháng, một xeô tôtương tự hoặc tốt hơn sẽ được cung cấp với mức phí tương tự hàng ngày. Nếu Người lái xe không hài lòng với chiếc xe mô tô thay thế, Người lái xe có quyền hủy bỏ ‘Thỏa thuận cho thuê’ và sau đó nhận lại 100% số tiền cho chiếc xe mô tô và thiết bị, tuy nhiên, Người lái xe không hủy đặt chỗ mà không có lý do. Việc hoàn lại tiền sẽ được xử lý kịp thời.
RIDING RESTRICTIONS

(a) All RIDERs must adhere to the following riding restrictions. If the RIDER is found to be in violation of any of the following restrictions, A.R.T VIET NAM TOURISM CO. LTD reserves the right to terminate the rental agreement and take immediate possession of the motorcycle. Additionally, if it is found that damage of any kind has occurred to the motorcycle or any equipment due to a breach of any of these rules, the insurance coverage may be nullified and voided and the financial repercussions are solely the responsibility of the RIDER and may exceed and are not limited to the amount of the deductible.
(a) Tất cả Người lái xe phải tuân thủ các giới hạn đi xe sau đây. Nếu Người lái xe bị phát hiện vi phạm bất kỳ hạn chế nào sau đây, A.R.T VIET NAM TOURISM CO. LTD có quyền chấm dứt hợp đồng thuê và sở hữu ngay xe mô tô. Ngoài ra, nếu phát hiện có thiệt hại dưới bất kỳ hình thức nào xảy ra đối với xe mô tô hoặc bất kỳ thiết bị nào do vi phạm bất kỳ quy tắc nào trong số quy tắc này, phạm vi bảo hiểm có thể bị vô hiệu và vô hiệu và các hậu quả tài chính do Người lái xe hoàn toàn chịu trách nhiệm vượt quá và không giới hạn số tiền khấu trừ.
(b) Anyone who does not have a ‘Rental Agreement’ and the A.R.T VIET NAM TOURISM CO. LTD ‘Terms and Conditions’ is not permitted to operate an A.R.T VIET NAM TOURISM CO. LTD motorcycle.
(b) Bất kỳ ai không có ‘Thỏa thuận cho thuê’ và ‘Điều khoản và Điều kiện’ của A.R.T VIET NAM TOURISM CO. LTD đều không được phép vận hành xe mô tô của A.R.T VIET NAM TOURISM CO. LTD.
(c) The RIDER must be ride in a safe and responsible manner.
(c) Người lái xe phải đi xe một cách an toàn và có trách nhiệm.
(d) The use of the motorcycle is restricted to Vietnam. Taking the motorcycle out of Vietnam is not permitted.
(d) Việc sử dụng xe mô tô bị hạn chế ở Việt Nam. Không được phép mang xe mô tô ra khỏi Việt Nam.
(e) All and any form of stunt riding or racing is not permitted.
(e) Tất cả và mọi hình thức biểu diễn hoặc đua xe đều không được phép.
(f) No unauthorized modifications or adaptations to the motorcycle are permitted of any kind.
(f) Không được phép sửa đổi hoặc điều chỉnh trái phép đối với xe mô tô dưới bất kỳ hình thức nào.
(g) Riding in extreme weather conditions is not recommended and any damage caused to the motorcycle will be the sole responsibility of the RIDER.
(g) Không nên đi xe trong điều kiện thời tiết khắc nghiệt và bất kỳ thiệt hại nào gây ra cho xe mô tô sẽ do Người lái xe chịu trách nhiệm duy nhất.
(h) Riding without a helmet is illegal and not permitted at any time for any reason. The RIDER shall not allow a passenger to be on the motorcycle without a helmet.
(h) Lái xe không đội mũ bảo hiểm là vi phạm pháp luật và không được phép vào bất kỳ lúc nào vì bất kỳ lý do gì. Người lái xe không được phép cho người ngồi trên xe máy mà không đội mũ bảo hiểm.
(i) The RIDER must at all times be in possession of the motorcycle registration (blue card) and insurance documentation and must also be in possession of all necessary documentation as stated in the ‘Rider Requirements’ section of this document.
(i) Người lái xe luôn phải sở hữu đăng ký xe (thẻ xanh) và giấy tờ bảo hiểm và cũng phải sở hữu tất cả các giấy tờ cần thiết như đã nêu trong phần ‘Yêu cầu của người lái’ của tài liệu này.
(j) Use of the motorcycle for commercial purposes requires written permission in advance.
(j) Việc sử dụng xe mô tô cho mục đích thương mại cần có sự cho phép trước bằng văn bản.
(k) Tampering with the odometer of the motorcycle is strictly forbidden.
(k) Nghiêm cấm việc giả mạo/ can thiệp vào đồng hồ đo quãng đường của xe mô tô.
(l) Subleasing the motorcycle to any other person is not permitted.
(l) Không được phép cho người khác thuê lại xe mô tô.
ACCIDENT, RESCUE, REPAIR and OTHER UNFORESEEN CIRCUMSTANCES
TAI NẠN, TÁI TẠO, SỬA CHỮA và CÁC TÌNH HUỐNG KHÁC
(a) All A.R.T VIET NAM TOURISM CO. LTD motorcycles come with roadside assistance which is available throughout Vietnam. In the event of any mechanical failure or any other incident that renders the motorcycle un-drivable, it is the responsibility of the RIDER to contact A.R.T VIET NAM TOURISM CO. and inform us of the details.
(a) Tất cả xe máy của A.R.T VIET NAM TOURISM CO. LTD đều có hỗ trợ bên đường có sẵn trên khắp Việt Nam. Trong trường hợp hỏng hóc cơ học hoặc bất kỳ sự cố nào khác khiến xe mô tôkhông thể lái được, Người lái xe có trách nhiệm liên hệ với CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM và thông báo chi tiết cho chúng tôi.
(b) In the event of an accident, it is the responsibility of the RIDER to contact the police (on 113), as soon as possible. Failure to do so will nullify the motorcycle insurance coverage, and lead to serious financial and legal consequences for the RIDER. After contacting the police, the RIDER must immediately inform A.R.T VIET NAM TOURISM CO. LTD of the details.
(b) Trong trường hợp xảy ra tai nạn, Người lái xe có trách nhiệm liên hệ với cảnh sát (theo số 113) càng sớm càng tốt. Nếu không làm như vậy sẽ vô hiệu phạm vi bảo hiểm xe mô tô và dẫn đến hậu quả nghiêm trọng về tài chính và pháp lý cho Người lái xe. Sau khi liên hệ với cơ quan cảnh sát, Người lái xe phải thông báo ngay cho CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM để biết chi tiết.
(c) The RIDER is 100% responsible and liable for all traffic and parking violations. The RIDER must inform A.R.T VIET NAM TOURISM CO. LTD of any violations and must pay the fine in a timely manner.
(c) Người lái xe chịu trách nhiệm 100% về mọi vi phạm giao thông và đỗ xe. Người lái xe phải thông báo cho A.R.T VIET NAM TOURISM CO. LTD nếu vi phạm và phải nộp phạt kịp thời.
(d) A.R.T VIET NAM TOURISM CO. LTD ensures that all motorcycles and equipment are provided in good working order. A.R.T VIET NAM TOURISM CO. LTD will do everything possible to avoid any maintenance problems occurring during the RIDER’s trip. However, if a problem occurs which was caused by no fault of A.R.T VIET NAM TOURISM CO. LTD including sudden and unexpected mechanical breakdown or any incidents that were caused by a previous rider and were not picked up during regular inspection/service, then A.R.T VIET NAM TOURISM CO. LTD is not to be held liable for any consequences.
(d) A.R.T VIET NAM TOURISM CO. LTD đảm bảo rằng tất cả xe mô tô và thiết bị được cung cấp đều hoạt động tốt. A.R.T VIET NAM TOURISM CO. LTD sẽ làm mọi thứ có thể để tránh mọi sự cố bảo trì xảy ra trong chuyến đi của Người lái xe. Tuy nhiên, nếu sự cố xảy ra không phải do lỗi của CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM, bao gồm sự cố máy móc đột ngột và bất ngờ hoặc bất kỳ sự cố nào do người lái trước gây ra và không được khắc phục trong quá trình kiểm tra / bảo dưỡng định kỳ, thì ART VIỆT NAM TOURISM CO. LTD không chịu trách nhiệm về bất kỳ hậu quả nào
(e) The RIDER is responsible for checking and maintaining engine oil levels and must report any mechanical failures to A.R.T VIET NAM TOURISM CO. LTD immediately. The RIDER will be held responsible for mechanical damage caused due to negligence in motorcycle operation or failure to provide normal maintenance.
(e) Người lái xe có trách nhiệm kiểm tra và bảo dưỡng mức dầu động cơ và phải báo cáo ngay lập tức mọi hư hỏng cơ khí cho A.R.T VIET NAM TOURISM CO. LTD. Người lái xe sẽ phải chịu trách nhiệm về các hư hỏng cơ học do sơ suất trong vận hành xe máy hoặc không bảo dưỡng bình thường.
(f) If the RIDER’s trip is interrupted due to a faulty, damaged, or stolen motorcycle/equipment, A.R.T VIET NAM TOURISM CO. LTD will facilitate the repair or replacement of the motorcycle/equipment, so long as the RIDER has not acted negligently. A.R.T VIET NAM TOURISM CO. LTD reserves the right to determine the appropriate course of action in all cases.
(f) Nếu chuyến đi của Người lái xe bị gián đoạn do xe mô tô / thiết bị bị lỗi, hư hỏng hoặc bị mất cắp, CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM sẽ tạo điều kiện sửa chữa hoặc thay thế xe mô tô / thiết bị, miễn là Người lái xe không có hành động sơ suất . A.R.T VIET NAM TOURISM CO. LTD có quyền quyết định hành động phù hợp trong mọi trường hợp.
(g) In the case of damage, theft, or any other kind of incident involving the motorcycle or any equipment, which interrupts the RIDER’s trip and which A.R.T VIET NAM TOURISM CO. LTD determines to warrant a replacement motorcycle, it is the responsibility of the RIDER to pick up the replacement motorcycle at a designated location to be determined by A.R.T VIET NAM TOURISM CO. LTD A.R.T VIET NAM TOURISM CO. LTD is not liable for any loss of time due to such an incident, nor will compensation be provided for any expenses incurred by the RIDER due to the incident. It is therefore highly recommended that the RIDER obtain travel insurance so that the RIDER is covered in any such incident.
(g) Trong trường hợp hư hỏng, mất cắp, hoặc bất kỳ sự cố nào khác liên quan đến xe mô tô hoặc bất kỳ thiết bị nào làm gián đoạn chuyến đi của Người lái xe và CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM quyết định bảo hành xe mô tô thay thế, đó là trách nhiệm của Người lái xe đến nhận xe mô tô thay thế tại một địa điểm đã được xác định bởi CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM không chịu trách nhiệm về bất kỳ sự cố mất thời gian nào do sự cố đó gây ra, cũng như không bồi thường bất kỳ chi phí nào mà Người lái xe phải chịu do sự cố. Do đó, Người lái xe rất nên mua bảo hiểm du lịch để Người lái xe được bảo hiểm trong bất kỳ sự cố nào như vậy.
(h) In the case of damage, theft, or any other incident which results in unforeseen expenses A.R.T VIET NAM TOURISM CO. LTD reserves the right to charge the RIDER. For costs that are not covered by A.R.T VIET NAM TOURISM CO. LTD insurance, the RIDER will be held fully responsible and liable. A.R.T VIET NAM TOURISM CO. LTD will charge the RIDER accordingly.
(h) Trong trường hợp hư hỏng, mất cắp, hoặc bất kỳ sự cố nào khác dẫn đến chi phí không lường trước được A.R.T VIET NAM TOURISM CO. LTD có quyền thu phí Người lái xe. Đối với các chi phí không thuộc phạm vi bảo hiểm của A.R.T VIET NAM TOURISM CO. LTD, Người lái xe hoàn toàn trách nhiệm và nghĩa vụ. A.R.T VIET NAM TOURISM CO. LTD sẽ tính phí Người lái xe tương ứng.
(i) In the event of any damage to or loss of the motorcycle or any equipment, A.R.T VIET NAM TOURISM CO. LTD the full damage deposit will be retained unless the ultimate cost to repair or replace the item is less than the full amount of the deposit. A.R.T VIET NAM TOURISM CO. LTD will refund the excess amount and will send the RIDER a copy of the receipt for repairs or replacement. In the event that A.R.T VIET NAM TOURISM CO. LTD.’s insurance is nullified or voided due to Rider negligence and the cost to repair or replace the item(s) is more than the full amount of the deductible, A.R.T VIET NAM TOURISM CO. LTD will charge the RIDER’s credit card for the full remaining amount.
(i) Trong trường hợp có bất kỳ hư hỏng hoặc mất mát nào đối với xe mô tô hoặc bất kỳ thiết bị nào, CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM sẽ giữ lại toàn bộ tiền đặt cọc thiệt hại trừ khi chi phí cuối cùng để sửa chữa hoặc thay thế vật phẩm thấp hơn toàn bộ số tiền tiền đặt cọc. A.R.T VIET NAM TOURISM CO. LTD sẽ hoàn trả lại số tiền thừa và sẽ gửi cho Người lái xe bản sao biên lai để sửa chữa hoặc thay thế. Trong trường hợp bảo hiểm của CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM bị vô hiệu do người lái sơ suất và chi phí sửa chữa hoặc thay thế (các) hạng mục cao hơn toàn bộ số tiền được khấu trừ, CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM . LTD sẽ tính toàn bộ số tiền còn lại vào thẻ tín dụng của RIDER.
(j) In the event of an insurance claim, it is the responsibility of the RIDER to cooperate fully with A.R.T VIET NAM TOURISM CO. LTD in order for A.R.T VIET NAM TOURISM CO. LTD to carry out the formalities required by A.R.T VIET NAM TOURISM CO. LTD.’s insurance provider. Failure to do so will nullify the insurance coverage and may lead to financial repercussions, which are solely the responsibility of the RIDER and may exceed and are not limited to the amount of the damage deposit.
(j) Trong trường hợp có yêu cầu bảo hiểm, Người lái xe có trách nhiệm hợp tác toàn diện với CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM để CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM thực hiện các thủ tục theo yêu cầu của Nhà cung cấp bảo hiểm của ART VIET NAM TOURISM CO. LTD. Nếu không làm như vậy sẽ vô hiệu phạm vi bảo hiểm và có thể dẫn đến hậu quả tài chính, do Người lái xe hoàn toàn chịu trách nhiệm và có thể vượt quá và không giới hạn số tiền đặt cọc thiệt hại.
(k) If damage is not recognized at drop-off, but is recognized within 7 days thereafter, A.R.T VIET NAM TOURISM CO. LTD has the right to charge the RIDER’s credit card in order to make the necessary repairs or replacement. A.R.T VIET NAM has the right to request an independent inspection from a certified mechanic, the rider will bear the cost of this inspection.
(k) Nếu hư hỏng không được ghi nhận khi trả lại xe mô tô, nhưng được ghi nhận trong vòng 7 ngày sau đó, A.R.T VIET NAM TOURISM CO. LTD có quyền tính phí thẻ tín dụng của Người lái xe để thực hiện các sửa chữa hoặc thay thế cần thiết. A.R.T VIET NAM có quyền yêu cầu kiểm tra độc lập từ thợ máy được chứng nhận, người lái sẽ chịu chi phí kiểm tra này.
(l) A.R.T VIET NAM TOURISM CO. LTD is not responsible for any delays and interruptions to trips caused by extreme weather, flight delays, earthquakes or any other acts of nature/acts of God. A.R.T VIET NAM TOURISM CO. LTD takes no responsibility for punctures. A.R.T VIET NAM TOURISM CO. LTD takes no responsibility for any mechanical problems caused through RIDER negligence and/or lack of care and regular maintenance by the RIDER. Nor shall A.R.T VIET NAM TOURISM CO. LTD be responsible or liable for any trip delays. Additionally A.R.T VIET NAM TOURISM CO. LTD is not responsible or liable for any injury, illness or death of any person during the trip. The RIDER indemnifies and holds A.R.T VIET NAM TOURISM CO. LTD harmless against any claim.
(l) A.R.T VIET NAM TOURISM CO. LTD không chịu trách nhiệm về bất kỳ sự chậm trễ và gián đoạn nào đối với các chuyến đi do thời tiết khắc nghiệt, chuyến bay bị hoãn, động đất hoặc bất kỳ hành vi nào khác của thiên nhiên / tác động của Thượng đế. CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM không chịu trách nhiệm về các vết thủng. A.R.T VIET NAM TOURISM CO. LTD không chịu trách nhiệm về bất kỳ sự cố máy móc nào do Người lái xe sơ suất và / hoặc thiếu sự chăm sóc và bảo dưỡng thường xuyên của Người lái xe. A.R.T VIET NAM TOURISM CO. LTD cũng không chịu trách nhiệm hoặc nghĩa vụ đối với bất kỳ sự chậm trễ của chuyến đi. Ngoài ra A.R.T VIET NAM TOURISM CO. LTD không chịu trách nhiệm hoặc nghĩa vụ đối với bất kỳ thương tích, bệnh tật hoặc tử vong của bất kỳ người nào trong chuyến đi. Người lái xe bồi thường và coi CÔNG TY TNHH DU LỊCH A.R.T VIỆT NAM là vô hại đối với bất kỳ khiếu nại nào.
MOTORCYCLE DROP-OFF
TRẢ XE MÁY
(a) Fuel costs are the responsibility of the RIDER. All motorcycles come with a full tank of gas and are to be returned with a full tank of gas.
(a) Người lái xe chịu trách nhiệm về chi phí nhiên liệu. Tất cả xe mô tô đều đi kèm với một bình xăng đầy và phải được trả lại với một bình xăng đầy.
(b) Motorcycles returned late will incur an hourly late fee of 20% of the daily rate for that motorcycle. Motorcycles and any equipment returned 5 hours late or more will incur a full day of additional charges. All late fees will be charged to the RIDER.
(b) Xe mô tô bị trả lại trễ sẽ phải chịu phí trả chậm hàng giờ là 20% mức phí hàng ngày cho xe mô tô đó. Xe mô tô và bất kỳ thiết bị nào được trả lại muộn từ 5 giờ trở lên sẽ phải chịu phụ phí cả ngày. Tất cả các khoản phí trễ hạn sẽ được tính cho Người lái xe.
(c) If upon inspection of the motorcycle and equipment, it is determined that any A.R.T VIET NAM TOURISM CO. LTD property has been damaged, lost or stolen, or if A.R.T VIET NAM TOURISM CO. LTD has incurred or will incur any other expenses related to bringing the motorcycle and any equipment back to its original state and appropriate location, then A.R.T VIET NAM TOURISM CO. LTD will charge the RIDER in accordance with these terms and conditions.
(c) Nếu khi kiểm tra xe mô tô và thiết bị, xác định rằng bất kỳ tài sản nào của CÔNG TY TNHH DU LỊCH NGHỆ THUẬT VIỆT NAM đã bị hư hỏng, mất mát, mất cắp hoặc nếu CÔNG TY TNHH DU LỊCH NGHỆ THUẬT VIỆT NAM đã phát sinh hoặc sẽ chịu bất kỳ chi phí nào khác liên quan đến việc đưa xe mô tô và mọi thiết bị về trạng thái ban đầu và vị trí thích hợp thì CÔNG TY TNHH DU LỊCH NGHỆ THUẬT VIỆT NAM sẽ tính phí Người lái xe theo các điều khoản và điều kiện này.
(d) The motorcycle is to be returned to the agreed upon drop off location. The rider does not have the option to arbitrarily drop off the motorcycle at another location without approval in advance.
(d) xe mô tô phải được trả lại địa điểm đã thỏa thuận. Người lái xe không có quyền tự ý trả lại xe mô tô ở địa điểm khác mà không được chấp thuận trước.
(e) The non-return of the motorcycle to the agreed upon drop off location and date, without A.R.T VIET NAM TOURISM CO. LTD approval, will be considered a criminal offense. Non-return of the motorcycle by the predetermined time of drop-off may lead to financial repercussions, which are the sole responsibility of the RIDER and may exceed and are not limited to the amount of the damage deposit.
(e) Việc đưa xe mô tô đến địa điểm và ngày trả lại xe đã thỏa thuận mà không được A.R.T VIET NAM TOURISM CO. LTD chấp thuận, sẽ bị coi là một hành vi phạm tội. Việc không trả lại xe mô tô vào thời gian đã định trước có thể dẫn đến hậu quả về tài chính, đây là trách nhiệm duy nhất của Người lái xe và có thể vượt quá và không giới hạn số tiền đặt cọc thiệt hại.
